When is a Building Permit Required?

The Village of Roslyn Harbor requires permits for indoor and outdoor structural work, freestanding structures, or major changes to the living area of a home.  The permit process ensures that all construction done in the Village meets the minimum safety standards of the New York State Uniform Fire Prevention and Building Code, as well as Village Code and Zoning Requirements.  Please call the Building Department before proceeding with any work to find out if a building permit is required.

Yes, you need a building permit for the following residential projects: (This list is not all-inclusive.  Please contact the Building Department with specific questions).

  • New Buildings and Structures

  • Additions, Alterations and Structural Changes

  • Trellises, Gazebos and Pergolas 

  • Build or Replace a Fence (Unless an Exact Replacement)

  • Sports Courts of Any Kind

  • Install, Repave or Replace a Driveway

  • Install and/or replace Heating Unit, Air Conditioning or Water Heater

  • Install or Replace Decks, Patios, Porches, Walkways, Stoop/Stairs or Porticos

  • Build or Replace a Shed

  • Replace or Substantial Repair of a Roof

  • Fireplaces, Including Decorative Gas Fireplaces

  • Install or Repair Swimming Pools, Hot Tubs and Saunas

  • Demolition of Any Structure

  • Removal of Finishes to Stud

  • Stairs

  • Generators

  • Oil to Gas Conversion and Oil Tank Abandonment

  • Install, Remodel or Replace Kitchen or Bathroom

  • Replace an Electric Stove with a Gas Stove

  • Finish or Remodel a Basement

  • Car Lift

  • Car Charging Station

  • Dumpsters and/or Pods Not Associated with a Building Permit

  • Adding, Upgrade or Replace Electric or Plumbing Systems

  • Solar Panels

  • Install or Replace Cesspool, Septic Tank or Drywell

  • Install New or Replace Existing Windows (Unless an Exact Replacement)

  • Install New or Replace Existing Siding (Unless an Exact Replacement)

  • Landscaping Plans, Including Site Grading and Alterations

  • Retaining Walls or Berms

  • Fill 

  • Road Openings and Curb Cuts

  • Public Assembly

  • Tree Removals

  • Change of Use

  • Maintain and Legalize Any Building, Structure or Space Constructed or Installed Without a Permit

  • Temporary Tent

No, you do not usually need a building permit for the following residential projects:

  • Painting Exterior or Interior Walls.

  • Replacing a Window or Door with the same size/type unit and within the same framed opening unless you are replacing 50% or more of the windows.

  • Installing New Flooring.

  • Replacing a Faucet.

 ADDITIONAL INFORMATION

  1. Some projects may require a new or updated septic system. Please submit if required.

  2. Repairs are required to comply with State and Village Codes and Standards.

  3. Sheds under 100 sf, do not require a building permit but are subject to village zoning and setbacks from buildings/structures and property lines.

  4. All Plumbing and Electrical Work MUST be done by a Licensed Plumber or Licensed Electrician.

  5. All Structural Work MUST be done by a Licensed and Insured Contractor.
